MP to contest scrapping of new district

An MP is set to challenge a High Court ruling that nullified the creation of. North Mugirango MP Wilfred Ombui on Monday also said he would introduce a motion in Parliament seeking to amend the Districts and Provinces Act to ensure the newly-created administrative units conform to the legal requirements.

Last Friday, Mr Justice Daniel Musinga ruled that the district created by President Kibaki did not conform to the Constitution.

“A district is an important administrative and political region to the extent that it is recognised in the Constitution and any violation of its boundaries must be done in adherence to the relevant law,” the judge said in a ruling in a case in which Mr Job Nyasimi and Mr Peter Nyamekendo had challenged the Attorney-General and the Interim Independent Boundaries Review Commission over the legality of the district.

Separately, 11 councillors from Ekerenyo Division on Monday said they would resist any attempt to snatch the district from the area.

“Nyamira North District is among several districts that were created by the President recently under the same legal frame work... It defeats logic therefore when only our district is declared unconstitutional and illegal,” Mr Ben Nyaberi said on behalf of the councillors.
