Magara loses his parliamentary seat

Kisii High Court Judge Daniel Musinga Thursday declared the election of the Trade assistant minister  null and void in an election petition filed against him by Manson Oyongo Nyamweya.  

Justice Musinga said the returning and presiding officers had committed an election offense by failing to sign form 16A in several polling stations.

He said such an election offense overrides Magara's lead of 10,024 votes against Nyamweya's 5,334 votes in the recount exercise.

Magara's loss becomes the second of its kind in a trend that has seen the judiciary expedite the hearing of election petitions.

Last year, Joel Onyancha lost the Bomachoge seat in a petition due to irregularities including
incomplete forms 16A.

A subsequent by-election in Bomachoge saw Onyancha lose to Simon Ongari.

Profile

The immediate former South Mugirango MP James Omingo Magara inherited the seat from his elder brother Enock who died in a road accident in October 2000.

Born on 24th December 1961 Magara was first elected as a Member of Parliament for South Mugirango Constituency during a By-Election held on 12th January 2001.

He was re-elected as a Member of Parliament for the same Constituency during the 2002 general election.

Magara holds a Bachelor of Commerce Degree from Punjab University. He is also a certified Public Accountant of Kenya - CPA (K) and a member of the Institute of the Certified Public Accountants of Kenya (ICPAK).

He is currently pursuing an MBA degree at the University of Nairobi. He has worked with Income Tax
department at the Ministry of Finance.

He has also worked with the Kenya Revenue Authority where he resigned as a Senior Assistant Commissioner of Value Added tax.
