The court will rule on Tuesday whether the Bomachoge by-election slated for Thursday will go on.
The poll is a major challenge for the Interim Independent Electoral Commission as it is the first one that it is supervising.
This follows the disbandment of the Electoral Commission of Kenya (ECK) over the disputed results of the 2007 election.
The ruling arises out of a case filed by an aspirant, Mr Fedinard Ondabu Obure, who is challenging the decision to lock him out of the race.
Mr Obure and Mr Richard Kalembe Ndile of the Tip party have asked the High Court to stop the poll until their case is determined.
