Court suspends chiefs appointment

A Kisii high court has suspended for 21 days the appointment of three chiefs in Masaba South district pending termination of an application for Judicial Review.
Lady Justice Ali Aroni sitting in Kisumu also issued temporary orders to Nyanza Provincial Commissioner (PC) Francis Mutie not to retain other officers or fill the vacancies within the period.
Three unsuccessful applicants for the positions, Michira Albert Nyansimera, Kepha Obonyo Gesure and Julius Machogu Nyauma from Riamakanda,Masabo and Geteri locations had gone to court to contest the appointments.
In their application filed through, Cyrus Minda, the PC was enlisted as the respondent.
Current holders of the offices, Philip Basweti, Kennedy Dickson Omariba and the Permanent Secretary, Office of the President Provincial Administration and Internal Security were enjoined as interested parties.
The application certified as urgent sought to institute Judicial Review to direct the PC to comply with the contents of the PS's letter to him of November 3 ,2010.
According to the letter,the PC had been instructed to appoint the applicants among others as chiefs.
