Nafula found Mochobo guilty of robbing Ntenga as her evidence was overwhelmingly incriminates the first accused and it had been corroborated. “I have no doubt in my mind that the first accused has been placed in the first complainant’s compound on the night of the robbery and convict him accordingly,” ruled Nafula. “I proceed to sentence the accused to serve the mandatory sentence of death for the first count,” she further ruled.Ntenga, the complainant in the first count told the court that on the said date, she reported to Nyangusu police that she had received threats from some people warning her that she would not stay in her compound.
That same night as she slept, hooded robbers attacked her compound. She struggled with them after hitting one on the face and disarming another prompting them to flee into her banana farm. She identified the attackers using light from her 12 battery torch before running to Riokindo AP post to report the attack.
