Man sent to the gallows for robbery

A man has been sent to the gallows by a Gucha court for violently robbing a woman.Simion Oywonga Mochobo committed the offence on the night of December 2, 2009 at Bokimonge sub location in Kenyenya District, jointly with Peter Oywonga and Majuma Gekwabe. They were charged jointly with others not before court, with violently robbing Consolata Ntenga of two big torches, 20 chicken, assorted household goods and Sh47,875 cash. The accused was also charged with violently robbing Jackline Kemunto and Simon Ntenga of Sh70,000 and Sh15,000 respectively.
He denied committing the offence. Mrs Ntenga, the complainant in the first count, told the court that on that day, she reported to Nyangusu police that she had received threats from some people warning her that she would not stay in her compound.That same night as she slept, hooded robbers attacked her compound. She struggled with them after hitting one on the face and disarming another prompting them to flee into her banana farm.
She identified the attackers using light from her 12 battery torch before running to Riokindo AP post to report the attack. Upon return in the company of APs, she found her son Bonface cut to death and two other children seriously injured and the said items stolen.Ogembo Principal Magistrate Lily Nafula said Ntenga’s evidence overwhelmingly incriminates the first accused and it had been corroborated. "I have no doubt in my mind that the first accused has been placed in the first complainant’s compound on the night of the robbery and convict him accordingly," ruled Nafula. She said the second and third accused had not been identified and, therefore, gave them the benefit of doubt before acquitting them.
