Nyambati Poll Petition Resumes

THE hearing of the Kitutu Masaba petition against the election of Walter Nyambati resumes today at the Kisii High Court. The case filed by Justus Omiti, a voter, will be heard on a daily basis from today to March 17 except on Fridays, according to Judge Asike Makhandia.
Omiti finished giving evidence on February 17 after more than five days in the witness stand. The second witness is expected to be Timothy Bosire, who was the ODM candidate.The petitioner will call more than 10 witnesses, according to his lawyer Otiende Amollo who told court that they had filed 16 affidavits.
In his evidence, Omiti claimed the tallying process was marred with irregularities and demanded a recount and scrutiny of election materials. Omiti wants the election of Nyambati nullified citing anomalies and irregularities.
Omiti has named Nyambati as the first respondent, the returning officer Lawrence Sempele and the electoral commission as the second and third respondents. The case which was filed three years ago has been marked by sideshows and several adjournments. Nyambati has been accused of seeking to delay the hearing of the case
