Jailed for raping woman in front of children

A man who claims to have lost his mind has been jailed for 15 years for rape. David Ondieki Oyaro committed the offence on June 4, last year, at Nyamesocho village in Kenyenya, Kisii.He appeared before Ogembo Resident Magistrate Richard Koech and denied committing the offence.

On the day of the incident, the complainant, who was stranded at Nyamesocho while on her way to Nyangusu market accompanied by three children, saw four men advancing towards her.

The accused sounded sympathetic and offered to accommodate her at his residence.Fearing for her life and that of her children aged between eight months and eight years, she obliged.The stranger led her to a room not far away where he ordered her to undress, threatening to kill her using a sword. He also stole Sh5,300 from her.

Switched off tin lamp

He switched off the tin lamp, pulled a rug from under the bed and ordered the children to sleep on it.He rebuffed her appeal to use a condom, saying he had none and won’t use one.She submitted and was raped three times. In the morning, she left and narrated her ordeal to a resident.

The woman took her to a clan elder, who arrested the suspect with the help of other men after she positively identified him.She reported the matter to police at the Nyangusu Police Station before seeking medical attention.In mitigation, the accused said he lost his mind in 1978 and may have been mad. 

"I was drunk when this woman, who is my wife, came to visit and we had sex," the accused told the court.In his ruling, Koech said the complainant underwent a horrific ordeal in utterly humiliating circumstances before her kids and that she was vulnerable as a mother."The sophistry of the plot is of a sane mind as opposed to claims he is insane. The questions he asked in court were well thought out and critical. He has shown no remorse for his heinous act," ruled Koech, before meting out the sentence.
