Kisii Judge Set to Give Ruling

Kisii High Court Judge Justice Milton Makhandia will today make a ruling on an application seeking to have partial scrutiny of ballot boxes used in the Kitutu Masaba election.

Justice Makhandia is expected to deliver his ruling on the application made by the petitioner Justus Omiti. Omiti through his lawyer made the application after eight witnesses finished giving their evidence against area MP Walter Nyambati.

During submissions, Nyambati's lawyer Osoro Mogikoyo had asked the court to strike out the application arguing that it was immaterial in law.

Mogikoyo told Justice Makhandia that the application was made verbally, no affidavit was sworn, and there were no facts given to show the reason it was made.
