Gesami wants Mugirango CDF kitty freeze lifted

Mugirango West Member of Parliament James Gesami wants court orders touching on the management of Constituency Development Fund lifted. Lawyer Ochieng Oduol acting for Dr Gesami told the court that the court orders had caused suffering to needy school going children in Mugirango West Constituency who depend on bursaries.
The court had on April 8 2011 issued orders directing Gesami who is the patron of West Mugirango CDF to refund Sh1 million withdrawn from the fund’s account for personal use.
The trial judge Daniel Musinga also issued orders to Constituency Development Fund Board directing it to set in motion a process of reconstructing membership of West Mugirango CDF Committee.
Justice Musinga issued the order following the application by officials of the Millennium Forum for Unity and Development that he withdrew Sh1 million from CDF and deposited in his bank account.
Yesterday, lawyer Oduol said the orders were hurting the students who benefit from the bursaries. In his application to have the orders lifted, Dr Gesami argues that the court did not have jurisdiction in a judicial review case to issue the orders.
The officials of Millenium Forum for Unity and Development who instituted the suit had told the court that the CDF was being mismanaged. The parties were given until Friday to discuss and agree on issues of operation of the CDF account.
