Kisii widow summoned

The High Court in Kisii has ordered a widow who has sued former Kitutu Chache MP Jimmy Angwenyi for the killing of her husband to appear in court over contempt. Lydia Kemunto Ogoti was summoned by Resident Justice Milton Makhandia over remarks she made through the media. Defence lawyers Asha Nyakundi and David Wachira yesterday raised the concern after an interview aired by NTV.
Nyakundi and Wachira represent Angwenyi and his bodyguard corporal Richard Obonyo respectively who are accused of being involved in the killing of Robert Ogoti Obwori during the 2007 elections. Obwori died in a shoot-out outside Marani polling station as a group led by Angwenyi left the venue. Obonyo is facing a manslaughter charge at the Kisii Magistrate’s Court.
In the petition filed before Kisii Resident Judge Milton Makhandia, Kemunto claims that witnesses at the tallying hall saw the former MP shoot, but only his aide has been charged.
Wachira asked the court to summon the widow saying that during the interview she made several allegations about the case some of which were touching on matters pending before court. He said that the widow claimed that two files were missing and that the case has been dragging in court. The counsel said that the widow petitioned Chief Justice Willy Mutunga over the delayed case.
The widow has since filed a petition in the High Court seeking to have the case in which her husband was killed after Angwenyi lost in the 2007 parliamentary elections be heard afresh.
Making the ruling justice Makhandia said that matter was serious and cannot be ignored and ordered the petitioner to appear before him on July 22 to the complaints raised.
