Gesami faces arrest warrant

THE police can now arrest and prosecute Public Health assistant minister James Gesami for allegedly misusing CDF cash. The MP lost his bid to block his arrest. It was the second time Gesami was seeking to stop his arrest. Justice Mumbi Ngugi said Gesami's application lacked merit and ought to be dismissed.
The West Mugirango MP sought to be given 14 days to enable him appeal against Justice Ngugi’s ruling made two weeks ago. He wanted to file an appeal at the Court of Appeal. But the judge said the MP's application, just like his previous one, had nothing substantive. She further ordered the MP to pay the costs of the suit.
The assistant minister is being sought by the Anti Corruption and Ethics Commission for allegedly misusing constitunecy funds. He faces two criminal cases in Kisumu following complaints over alleged misuse of the CDF kitty. The warrant of arrest was issued against the MP at the Kisumu magistrate’s court in June last year following a successful application by the anti-graft agency.
It is alleged that Gesami failed to comply with the law and procedures relating to tendering of contracts. The agency claims the West Mugirango MP irregularly sought the services of Gracan Construction to carry out routine maintenance of the Kebirigo- Mosobeti Road at a cost of Sh2,497,900. And in challenging the case, Gesami said the prosecution has been brought for ulterior motives adding that the investigations and the charges against him are in gross of abuse of the court process.
