Kisii Municipal Council has given developers who have already allowed tenants to occupy their premises without obtaining an occupational certificate to clear the buildings for inspection.
The notice, issued by Kisii town clerk William Chepkwony, said the council has since noted that most of the developers had not been issued with the certificate as required by law.
“According to the Building Code By-laws 16(3) on occupational certificate, it has come to our attention as a council that your development has not been issued with occupational certificate,” Chepkwony said in the notice. “Therefore, you’re notified that within seven days date of this notice you’re instructed to move your tenants to allow the Council to inspect your buildings." The town clerk said legal action will be taken against those who fail to comply with the notice.
Speaking in his office, Eng William Wanyonyi said some developers had rented out incomplete premises putting the lives of the tenants at risk. “We don’t want a situation where developers accommodate tenants in incomplete buildings. They must complete and obtain occupational certificate from us,” Wanyonyi said adding that they have since begun to inspect building in the municipality.
