Man hauled to Kisii court over theft of girlfriend's ATM cash

A man was yesterday charged in a Kisii court for stealing his girlfriend’s money using her ATM card without her knowledge. Benjamin Nyamweya was charged that between May 19 and 29, he stole Sh109, 840 at Equity Bank Kisii branch from the account of Asnah Onwong’a. Nyamweya pleaded not guilty to the charge before chief magistrate Esther Maina who ordered that he be released on a bond of Sh150,000 and surety of similar amount. He couldn't raise the bond and has been remanded in custody.

Giving her evidence, Onwong’a told the court that she knows the accused because he is her friend. However she does not know where he lives. Onwong'a, an employee of Mwalimu Hotel, told the court she was preparing herself to go to work on June 2, 2011 when she found her ATM card on the floor. She said that she usually kept it in her handbag together with the PIN number, and the accused was not in the house when she found it. “I had not removed the ATM card from my handbag. I decided to go to the bank to check the balance that is when I discovered something was amiss,” she said. She told the court that she had Sh109,840, but upon checking she only found a balance of Sh159 saying that she had not withdrawn any money previously.
