Ex-Mayor On Capital Charges

A former deputy mayor was yesterday charged with violent robbery.

Mr Livingstone Omoke, who was brought to court under tight security, denied the charge before a Kisumu court and was remanded in custody until February 13.

The former civic leader was charged with robbing Councillor Milkah Nyaosi while armed. Mrs Nyaosi, who was the councillor of Suneka Ward in Kisii, has since died. He also allegedly robbed the councillor's husband, Mr Henry Nyaosi, of cash and property valued at Sh870,800 at Bogiakumu, Kisii District.

He was allegedly accompanied by others who were not in court.

Mr Omoke's lawyer, Mr Richard Onsongo, applied for an early hearing date, saying his client had a heart ailment.

"Even up to the time of his arrest, my client has been undergoing treatment. He is hypertensive and diabetic and requires constant treatment. I want a hearing date fixed for February 2," he pleaded.

But the prosecution opposed the application, saying it may not be easy to get all the witnesses quickly since they were from Kisii, about 100 kilometres away.

"We require at least two weeks to prepare and call witnesses," said Inspector Shem Obwak. The court then granted the prosecution two weeks and fixed the hearing for February 13.

The prosecution says Mr Nyaosi, a former senior police officer, was robbed of Sh50,000, a vehicle, a loaded pistol with 14 bullets, a TV set, video cassette and other household goods.
