The proprietor of a medical clinic who was arrested with 370 litres of chang'aa has been fined Sh7,000 by the Kisii Chief Magistrate's Court.
But while Patrick Arasa Magangi walked home after paying the fine, another woman who was found with 20 litres of the brew landed in jail for failing to raise a similar amount of fine. Magangi appeared before Chief Magistrate Jacob Ombonya and admitted that on October 27, this year at Kegati market, in Kisii District, he was found in possession of 370 litres of chang'aa.
After prosecutor Chief Inspector Francis Kipsang read the facts, the magistrate ordered he pays Sh7,000 or serve three months in jail.
On the other hand, Gladys Moraa Osoro was charged that she was found with 20 litres of the brew on the same day at Mwembe police road block along Kilgoris/Kisii route. She was fined Sh7,000 or three months in jail. And when news reporters visited the Kisii Law Courts Criminal Registry to peruse Moraa's file number 1783/02, it was discovered the sentence had been deleted and Sh7,000 read Sh3,000.
In another case, Monicah Kemuma Nyangara who was found with 8 litres of chang'aa at Jogoo estate, in Kisii town, was fined Sh4,000 or 30 days Community Service Order. She had not raised the amount by yesterday morning according to details in her file. She was arrested on Sunday.
