Magara's Brother Alleges Harassment

South Mugirango MP-elect James Magara's younger brother yesterday complained of police harassment while in hospital.

Mr. Titus Magara, who was discharged from the Tabaka Mission Hospital, Kisii, on Wednesday, said a group of police officers on several occasions demanded to be given his medical records but the hospital authorities declined.

The two brothers were admitted to the hospital on January 12 after they were attacked by hooligans in the Nyakieo area as they monitored the polling in the South Mugirango by-election.

Addressing a press conference at Chester House, the younger Magara said that the police officers would insult the Medical Officer of Health, Fr F. Avi, for not giving in to their demands.

He said he could not report the incident to the police because "they have not been helpful to us all along".

The MP-elect is still at the Aga Khan Hospital, Nairobi, while his younger brother is still nursing a fractured jaw and a cut on the head.

Meanwhile, 21 professionals have condemned the chaos during the South Mugirango by-election.

The professionals, who come from North Mugirango constituency but live in Nairobi, criticised their MP, Mr. Joseph Kiangoi, for allegedly assaulting an election official.

"We are deeply embarrassed that our MP, an advocate of the High Court, could act in a high-handed manner by slapping an election officer," they said in a statement.

They were addressing a news conference at Chester House.

Mr. Kiangoi was reported to have assaulted the Riosiri polling station returning officer, Mrs Lilian Mogendi.

He reportedly assaulted the official after she refused to accept fake documents by some voters. He has since denied the reports.

Yesterday, the 21 said Mr. Kiangoi should apologise to Kenyans. Their statement was read by lawyers Ahmael Tinega and Onyoni Opini.

They promised to shop for an alternative person to replace him come the 2002 elections.

During last weeks' by-election Ford-K's James Magara won, beating his nearest candidate, David Kombo of Kanu by more than 5,000 votes.

On Wednesday, five Nakuru businessmen dismissed claims by Kisii district Kanu branch chairman Mr. Geoffrey Asanyo that he was assaulted by youths saying it was a ploy to evade questions from Kanu headquarters.

They accused Mr. Asanyo of feigning injury to avoid questions on why the ruling party candidate Mr. David Kombo lost to Ford-Kenya's Mr. James Magara Nyakieya.

Mr. Jerry Ontiri, Mr. Joseph Gesumwa, Mr. Samson Nyairo, Mr. Elijah Ombogo, Mr. Evans Mageto and Mr. Charles Torori further claimed that the district chairman's illness was unbelievable and raised pertinent questions about his admission.

"Why did he travel 270 kilometres from South Mugirango to Nakuru to seek treatment. Can any injured man seek treatment 270 kilometres away when there are other hospitals nearby ?" they posed.
