The family believes that the road accident which killed him was "mysterious", Mr James Omingo Magara said yesterday on behalf of the family.
However, the family won't pursue the matter because of what it termed "respect for our late brother". The MP announced that there will be a memorial service for his brother at All Saints Cathedral, Nairobi, today at 9 am.
Nyaribari Chache MP Simeon Nyachae and Ford Kenya national chairman Kijana Wamalwa are expected to attend.
Another memorial service will be held on Friday, at Bomarongo village in Gucha district.
Mr Magara was elected as his brother's replacement in Parliament in by-election on a Ford Kenya party ticket.
He said: "Although we have resolved to allow the matter to rest there, we are still wondering why the accident was probed by the Criminal Investigations Department and not the Traffic police, as is normally the case."
Mr Magara also took issue with " the haste" in which the police closed the investigations file. This was done within a week of the accident.
The deceased died when his Mitsubishi Pajero rolled several times on the Kisii-Kisumu road. His driver and bodyguard were seriously injured.
His driver, Mr Boniface Otieno, and bodyguard, Mr Beret Omosa Anyona, were seriously injured and were admitted to Nyabondo Mission Hospital.
