Journalist to Get $16,250 for Illegal Arrest

Mr Peter Makori, who is based in Kisii, had sued the Attorney-General over his arrest and prosecution three years ago.
Through lawyer Ken Bosire Gichana, Mr Makori had demanded Sh3 million for general and aggravated damages.
During the hearing, the journalist told Kisii chief magistrate Jacob Ombonya, that at the time of his arrest he had gone to his home in Bonchari constituency to cover incidents of lynching of individuals suspected of dealing in witchcraft.
He said the police arrested him and two others, and locked them up in the local police station cells but did not say why he was arrested.
He learnt in the open court he had been charged with being in possession of 120 litres of kangara, a crude form of chang'aa.
The case was heard from August 1998 to June 1999. The journalist presented to court proceedings of the case in which him and his two co-accused were accused for lack of evidence.
Yesterday, Mr Ombonya ruled the journalist had proved his case and awarded him Sh1.3 million with costs of the suit plus four years' interest.
But he declined to award him Sh20,000 for special damages which he said had not been proved.
