The hearing of an election petition filed against the South Mugirango MP Omingo Magara might take longer than it was expected.
Hearing was once again postponed after the legislator filed another appeal stating that since he had not been properly served, he had a time limitation preparing for the case. Through his lawyer, James Orengo, Magara applied for the appeal as instructed by the Kisii High Court judge Daniel Musinga.
The petitioner Manson Nyamweya through his lawyer however said Magara was using delaying tactics in order to intimidate him.Nyamweya however said he would not be cowered by Magara's tactics saying it was also beneficial to him as he would use the time to gather more evidence to prove that Magara rigged in last years general elections.
Magara was granted the appeal and the case rescheduled for April 14 this year. Addressing the public outside the Kisii court Orengo said that he was sure that Magara had won the election justly and they were going to win the case.
Orengo refuted the claims from the petitioner that his client was just buying time and said that they needed to be well prepared for the case. "We don't need to buy time because we are sure of winning the case, we are just making sure that we are well prepared to fight the battle", said Orengo.
The lawyer predicted that Magara might be getting a ministerial post when a new cabinet is named and asked the people of Kisii to support him in his endeavours. However Nyamweya through his lawyer said that whether or not Magara was named a minister was beside the point as he would continue with the case since he was sure of winning.
