The court ordered for freezing of the bank accounts awaiting for final determination of the case whose judgment was made two weeks ago. The applicants had accused the MP who is also the Sports Assistant Minister of unfair disbursement of the funds and biased appointment of the committee members.
The Nairobi High court dismissed the suit on grounds that the applicants failed to provide proof to their allegations. Last week the committee under the chairmanship of Jacob Mogaka and the MP as the patron released some Shs 50m to various projects across the constituency. The projects to which the funds were allocated had been approved by the committee before the case was filed and the bank accounts frozen.
Among the projects which received the funding include roads, health facilities, water, constituency development office, schools, education bursaries among others. Addressing the gathering during the function Onyancha claimed that the case had been filed on political grounds. "The court suit was filed purposely. to finish me politically ahead of the general election but I'm pleased that the court has finally done justice by clearing my name and those of committee members," the minister said.
Speaking at Kenyenya Divisional Headquarters the minister said the case had delayed the implementation of approved projects in the constituency. He dismissed claims that some areas had been favoured during the allocation of the funds. 'The committee where I'm the patron has been approving and disbursing funds to projects whose proposals are forwarded across the constituency and were the priorities of the local people," he stated. Onyancha regretted that for the eight months the case was in court his people who were supposed to benefit from the funds were suffering singling out the university students who had benefited from the bursaries.
On the forthcoming elections the immediate Bomachoge MP pleaded with voters to re-elect President Mwai Kibaki and him as their next MP. "Since President Kibaki was elected in 2002 he has done a commendable job for Kenyans above all improving the country's economy and eradicating tribalism which was the order of the day during the former KANU regime, , he claimed.
He praised Kibaki for having appointed him to the cabinet. ''This is part of the development President Kibaki had done for you that I plead with you to support him during the polls," he said.
The immediate MP challenged the electorate to challenge hi opponents on their development records before casting their votes . "As the immediate former area I responded to your need and I deserve a re-election ince the development records of most of my opponents was below par," he added.
